Special prosecutor drops case against Mahama Ayariga citing inadequate evidence

Special Prosecutor Kissi Agyabeng has discontinued a case of alleged tax evasion against the Member of Parliament (MP) for Bawku Central.

According to Mr Agyabeng, the decision to discontinue the case is premised on the fact that evidence gathered by his predecessor in respect of the matter does not meet the threshold required for prosecution.

Mr Ayariga had been dragged to court by the first Special Prosecutor Martin Amidu for allegedly evading taxes in the purchase of some luxury vehicles.

Mr Ayariga had always denied the allegations and accused the Special Prosecutor of targeting him.

But the former Special Prosecutor insisted that the Bawku MP had breached some procurement processes in the purchase of ambulances for his constituency and also evaded tax in the importation of some “luxury vehicles”.

Commenting on the latest development Lawyer for Mahama Ayariga, Edudzi Tamakloe said that “He [Special Prosecutor] indicated that the evidential standard required in a criminal trial is proof beyond reasonable doubt and he is unable to do that with the evidence available to him. We are grateful to him and the courts for what has happened today”.

Meanwhile, in May 2021, it could be remembered that Accra High Court acquitted and discharged Bawku Central MP in the case of the purchase of an ambulance for the Bawku Municipal Assembly.
