Professor Kofi Abotsi, Dean of the University of Professional Studies-Accra (UPSA) School of Law, has expressed concerns regarding the decision by former Speaker of Parliament, Rt. Hon. Prof. Mike Aaron Oquaye, to remove the Fomena MP from Parliament.
According to him, the constitution does not prohibit a member of parliament from expressing intentions for future elections, but rather from switching party allegiance during the current parliamentary term.
Professor Abotsi clarified that the constitution focuses on the activities of the ongoing parliament, and declarations related to future parliaments do not fall under the same rules.
He added that parliamentary issues should be resolved within the house, and any decision by Parliament must be in line with constitutional provisions.
He emphasized that Article 97 of the constitution only applies when an MP crosses the floor during the current parliament, not when expressing future political ambitions.
