Four times Ghana Premier League champions Ashanti Gold SC last month secured an interlocutory injunction on the 2022-23 BetPawa Premier League over injustice.
The Miners were DEMOTED from the country’s elite Division as a result of match manipulations. But going to court to file an injunction on the Ghana Premier League, such put the ongoing league on hold.
The court orders from Accra Human Rights High Court restrained the Ghana Football Association from playing in the league.
However, the league was played ending in court as contempt.
On October 24, 2022, the Accra High Court dismissed the case by giving orders for the resumption of the league.
And in effect, charged the club GHC 20,000 as compensation.
Yet, another application injunction was secured to put on hold the BetPawa Premier League. Ashanti Gold SC filed the fresh case on Friday, October 28 2022 at the superior court of judicature in the court of appeal civil division, Accra.
Nevertheless, Ashanti Gold SC has withdrawn its application for an interlocutory injunction on the betPawa Premier League.
In court on Tuesday, November 08, 2022, Ashanti Gold failed to move their motion for the Court of Appeal to hear their legal arguments.
Before moving their motion, their lawyer, Sam Crabbe was raising arguments with the affidavit filed by the defendant Ghana Football Association(GFA).
The Appeals Court insisted that since Ashanti Gold is the one who has come to court for an injunction on the league, they move their motion for their substantive appeal to be heard before they raise arguments.
Ashanti Gold was unable to move their motion.
As a result of their inability to move and defend their motion at the Appeals Court, they eventually withdrew their appeal
The court then charged GHS5000 against AshGold.
Commentary:
~ This means that AshGold had no grounds for appeal but wanted to frustrate the free flow of the betPawa Premier League
~ A total of GHS25k has been awarded against AshGold for the GFA (20,000 at the High Court and 5,000 at the Appeals Court.
