The Office of the Special Prosecutor is bridle with a lot challenge which has to do with unseen power blocks from the government and top government officials interfering with the work of the office to fight corruption effectively.
Though the office is under resource express earlier by the former director Mr. Martin Amidu, the problem has not been addressed and it’s hindering the office operations to effectively fight corruption.
The Lead Crusader, Crusaders Against Corruption Emmanuel Wilson, said this on the Adekyee Mu Nsem on Ahotor 92.3 FM hosted by Citizen Kofi Owusu in Accra.
He disagrees with the Special Prosecutor Kissi Agyebeng on the grounds of the Judiciary interfering in his job. This he said in his opinion the Special Prosecutor is not well prepared with his brief and investigation been put before the law courts.
Sometimes after looking at some of his cases been thrown out of courts he agree with the law that, his submission lacks technicalities and interpretation of the law in his facts and investigation to the law courts.
He reiterated that the SP must be apt with his particulars and facts of the investigation since the Act. Establishing the office does not give him the right to pass judgment and sentence is not under his jurisdiction; rather the courts of law.
The Act that established the office gives him the powers to prosecute but then the office is under resourced and been under the Attorney General makes the office been inefficient to prosecute independently.
He believes this was one of his rarest moments since officially taking up the task of fighting corruption and corruption-related offences.
Though Kissi Agyebeng is never one to sound frustrated during public engagements, as his stance since becoming Special Prosecutor has projected a man ready for action,
“As I said, I wasn’t sounding like a prophet of doom but there is Doom looming ahead of us, that very soon a murderer will boldly walk to go to seek an injunction. Should I feel frustrated and resign? I took an oath and in my life when I take on the reins to do something, I do it to the best of my ability,’
According to Kissi Agyebeng, the judiciary is exhibiting some disregard for his office’s powers with what he sees as hasty dismissiveness of its cases.
Speaking at a press conference held in Accra Mr. Agyebeng described the trend as troubling. This Emmanuel Wilson said we can fight corruption without resources.
